What happens if I miss my trial date?

Normally, if you miss your trial date, the case will get dismissed. There are certain motions you can file in order to get another trial date. However, in many cases you might have to re-file the small claims complaints.

How many people can I sue?

You can sue as many individuals for your particular case.

What is the filing duration and the time frame of the trial date?

Small claims service may take up to 2-3 weeks. The application are filed with the courts and later returned for process of service against the defendant. The trial date is normally a month and a half to 2 months (depending on the case volume of that particular court).

How long does the small claims process take?

Once filed, trial dates are within 1-2 month. This give the plaintiff and the defendant plenty of time to make the proper arrangements.

What should I take with me on the day of the trial?

Contract, receipts, invoices, witness, documents, emails, pictures, audio tapes, video tapes, and etc. The more sufficient evidence, the better the outcome of your case.

When will I collect my judgment?

In most courts, once your win your case the defendant has 30 days to either file an Appeal or make a payment in full. If the defendant has failed to make an appeal and has failed to make payment, you can file certain motions with the courts that will allow you to (1) garnish wages or (2) seize person property and much more.

How long is a judgment good for?

In most courts, the judgment is good for 5-10 years and can be renewed. Daily interest may also be allocated.
